Terms of Service

These terms cover this website, the student portal, and TKO Prep programs. If you have signed a tutoring agreement with us, that agreement is the contract; this page fills in around it.

Our Services

What TKO Prep provides

  • TKO Prep LLC, a New York limited liability company, provides one-on-one test preparation, academic tutoring, and college counseling, along with the materials and reporting that go with them.
  • Programs are arranged with a parent or guardian and are set out in a written tutoring agreement. Where anything on this website differs from a signed agreement, the signed agreement controls.
  • Sessions are scheduled between the tutor and the student by mutual agreement.
  • Sessions are recorded in audio only, with no video, so that we can produce session notes, practice materials, and parent recaps. Consent to that recording is part of the tutoring agreement, and you can ask us to stop recording or delete a recording at any time.

Scheduling and Payment

Sessions, cancellations, and invoices

Cancellations, reschedules, no-shows, and late arrivals are covered by our Cancellation and Rescheduling Policy.

Rates depend on the tutor tier and hour package selected, as stated in your written package confirmation and on our tutoring and counseling pricing pages at the time of purchase. Prepaid packages are preferred; hourly clients are invoiced at the end of each month.

Card payments are processed by our payment processor and carry a card fee. Payment terms, including when invoices are due, are set out in your tutoring agreement.

Portal Accounts

Using the student portal

  • The student portal is for the use of the enrolled student and their parent or guardian. Please keep sign-in details private and let us know if you think an account has been accessed by someone else.
  • Accounts are for one student. Sharing an account with other families is not permitted.
  • We may suspend access to the portal if an account is being misused or if an account balance is significantly overdue.

Materials

Worksheets, notes, and reports

  • Worksheets, session notes, practice materials, and reports that TKO Prep produces are provided for the enrolled student’s own study.
  • Please do not republish, resell, or distribute TKO Prep materials outside your household.
  • Practice questions we write are our own. Where a session references official College Board or ACT material, that material belongs to those organizations and we do not reproduce it.

What We Do Not Promise

Results, estimates, and affiliations

  • We cannot guarantee a specific score, a score increase, or an admissions outcome. Results depend heavily on the work a student puts in.
  • The statistics shown on this website describe past students who completed a full TKO Prep program. Individual results vary.
  • The diagnostic and any score projections on this site are estimates meant to guide preparation. They are not official scores and are not issued by the College Board or ACT.
  • TKO Prep is not affiliated with, endorsed by, or sponsored by the College Board, ACT, or any college or university named on this site.

Ending a Program

Either side can stop

A program can be ended at any time by either the family or TKO Prep. On ending, you will be invoiced for sessions already completed and not yet paid.

If you prepaid a discounted hour package and did not use all of the hours, the hours you did use are re-priced at our listed rate for that tutor tier, and the balance of your prepayment is refunded. Your tutoring agreement states both the package rate you paid and the listed rate it discounts against, so the arithmetic is on the contract itself.

Changes to these terms

We may update these terms. The version on this page, with the date at the top, is the current one. A signed tutoring agreement is not changed by an update to this page.

Governing law

TKO Prep LLC is a New York limited liability company. These terms, and any dispute arising from them or from TKO Prep services, are governed by the laws of the State of New York, without regard to its conflict of laws rules.
